Another New EPA Proposal Would Gut NSR Provisions EPA Administrator Stephen Johnson announced at a press conference on October 13 that "EPA is eliminating NSR as a national enforcement priority." The US Environmental Protection Agency is proposing a new set of rule changes to the New Source Review (NSR) Provisions of the Clean Air Act that would have such a negative impact that apparently there is significant dissent within the agency itself. An internal memorandum from a top official in the Air Quality Enforcement Division of EPA , leaked to the Natural Resources Defense Council, calls the new rule changes "largely unenforceable and contrary to congressional intent." The new rule changes would remove annual emission standards and replace them with hourly standards for older power plants that are upgraded, renovated or expanded. This will enable expanded hourly operations of grandfathered facilities, without triggering the New Source Review process, despite greater annual emissions output. The effect of these changes will be to negate the purpose of the NSR provisions, meant to eventually phase out grandfather exemptions and to ratchet-down overall emissions over a period of time. The Canary Coalition has contacted NC Attorney General Cooper's office and urged him to aggressively oppose this new NSR revision that could have a profound negative effect on North Carolina's air quality. North Carolina is downwind from dozens of older power plants that will be allowed to expand operations and increase annual emissions if this new rule is allowed to be implemented.
